The following Terms and Conditions (“Terms”, “Terms of Service”, “Shop AudioBooks”) govern all use of our website https://shopaudiobooks.com  and services providing (collectively called as “website”). These terms also shall apply to all other content and services and products available at or through our website. All the terms on and through our website such as “we”, “us”, “our”, “us” refer to the Shop AudioBooks’ website and towards the creator and founder of e-Audio Productions LLC. The information is available on this website to you (“user”, “seller”, “author”) through these Terms and Conditions and conditioned on your acceptance of the terms, the policies, and everything else posted here. By using our services and website, you have engaged in our service, and you are bound by the terms and rules stated herein. All the terms in our Terms constitute an agreement between you and our services. These terms should be read together with our Privacy Policy and Terms and Conditions for Customers along with any other policies and together all these documents form an agreement between all users of our website (including sellers and buyers) and e-Audio Productions LLC. This agreement shall apply to you as a user, visitor, seller, author, or anyone in general who has used our services or accessed our website. If you are not in consent with the terms provided on this page or any one of the terms, you may not access the website in whole or in part and you also can not use any of our services.

SECTION 1- REQUIREMENTS

  1. Age Requirement

You must be at least 18 years old in order to use our services. If you are under, you do not have permission to use our services. 

  1. Not Barred By Law

You must otherwise not be barred by law from using mobiles, computers, the internet, or otherwise our software for whatever reasons. This specifically includes the people who have been convicted by the court of law for the illegal use of computers.  

  1. Personal Information Requirement For Registration 

To provide our users, the best services we may need personal information. This personal information may include your first name, last name, email, date of birth and other information as described in our Privacy Policy.  Please know that the information you may provide will only be used for the purpose of providing our services and will not be sold to any third parties.

  1. Automatic Information Collection 

There may be some information that will be collected automatically from the users when they use our website. To know more about it please read our Privacy Policy. 


SECTION 2 – EXPLANATIONS

In our Terms and Conditions for clients, the following terms will have the following meaning:

  1. “Agreement” shall mean the user’s consent in compliance with these Terms and Conditions, Terms and Conditions for Customers and our Privacy Policy.

  2. “Author” is the Seller of our website who is going to publish his/her literary work in audio form through our website.  

  3. “Buyer” or “Customer” means the user who is going to buy audiobooks posted by the Sellers or Authors from Shop AudioBooks’ website. 

  4. “COPPA” means “Children Online Privacy Protection Act” as described in our Privacy Policy. 

  5. “Customer” is the buyer as defined in sec 2.c. 

  6.  “EEA” means the European Economic Area. Please read our Privacy Policy for more details. 

  7. “FORCE MAJEURE” event means an event that is beyond our control. 

  8. “GDPR” means “General Data Protection Regulations”  as described in our Privacy Policy. 

  9. “Payment Methods” mean the methods under which the funds can be deposited. Currently, clients can deposit and make payments through PayPal using their credit or debit cards.    

  10. “Platform” means our website through which we are offering our services. 

  11. “Price” means the total price of the book listed by an author. 

  12. “Seller” means the person who is the original author as defined in section 2.b. 

  13. “Service” means the service attainable through our website.  

  14. “Service Fee” means the charges Shop AudioBooks’ website obtained from the Sellers/Authors. 

  15. “User” means anyone who is registered on our website. This includes the Sellers/Authors, Buyers, Customers or any other user, in general, using our website.   


SECTION 3 – DESCRIPTION OF SERVICE

Shop AudioBooks is a new author directory and platform that allows independent authors to have their own virtual shopfront on the site to showcase and sell their audiobooks to listeners. It allows audiobook lovers to purchase and download audiobooks directly from the authors.


SECTION 4 – CHANGE OF PERSONAL INFORMATION 

If the Sellers of our website change their information (like a change of book format, any contact information phone number, or e-mail) they must update the information on their account as well. We will not be held liable for any problems or communication errors due to a change of information. 


SECTION 5 – PAYMENT PLANS 

Sellers will pay a fee to list their work on our website however, they will hold all the copyrights related to their own work. Our website doesn’t control anything regarding recording, editing or marketing of the author’s work. We are only providing our services as an independent platform. The Sellers are also authorized to take all the income earned from selling their work. The amount that the Customers will pay will be directly deposited into the Sellers’ PayPal account. Henceforth, the sellers will be responsible for paying any taxes or incurred duties, levies, services charges or any other form of charges from selling their work. 

5.1. Authority Of Shop AudioBooks 

  1. No Refunds: We do not offer any refunds. All users have the right to cancel any time and their plan will remain active for at least one billing cycle and after that, their subscription will be canceled. 

  2. Payment Processing Problem: If there is an issue with processing subscription charges, the account will be put into ‘read-only’ mode. The account will remain this way until the issue is resolved and the payment has been successfully processed.  

  3. Breach Of Any Rules: If we find that anyone is breaking any rules or in any other case of suspicious behavior, we reserve the right to withdraw access to your account without notice for any actual or suspected breach of these terms or any other documentation referred to in them, including, without limitation, where we suspect that there has been unauthorized access to your account or any unauthorized disclosure of your login information.


SECTION 6- CONDITIONS OF USING OUR SERVICES AND GROUNDS OF TERMINATION

You Must Agree That:

  1. You must not reproduce, duplicate, copy or resell any part of our website or any content related to our website and e-Audio Productions LLC company, save and except to the extent expressly permitted in these Terms and Conditions. 

  2. You as an author will have all the legal rights to list your books on our website. You further acknowledge that you will also be responsible for setting the prices related to your literary audio work. 

  3. You must not, without our prior written consent, access, interfere with, damage or disrupt in any way our website and/or services or any part of it, our systems, any of our hardware or equipment, or any networks on which our website is hosted, any software that we use to create or modify the website or to make the website available to you, or any hardware, equipment, network, server, software or technology owned or operated by us or any third party.

  4. You must use our services for lawful purposes only and in accordance with these Terms and Policies.   

  5. You must not use the website for any purpose that is unlawful or that in any way breaches any applicable laws or regulations, whether local, national, or international.

  6. You will not conduct any unsolicited or unauthorized advertising or direct or indirect marketing to anyone by any means, or to otherwise spam, communicate with, or market to anyone any goods, services, or business not authorized by us.

  7. You must not in any way or for any purpose that breaches these Terms of Service or any of the documents these Terms refer to. 

Please note that failure to comply with any of the above rules, terms, and conditions may result in an immediate ban, termination of the account, and subscription and no refunds will be issued. 


SECTION 7- CONDUCT AND AUTHORITY OF SHOP AUDIOBOOKS’ WEBSITE  

Without limiting any of those representations or warranties, the CEO, Admin, or the owner of Shop AudioBook has the right to do the following without giving any notice. They have the right to refuse or remove any user’s account and published work from Shop AudioBooks’ website if in their reasonable opinion the work is violating any of the terms or any policy or is in any way harmful or objectionable. The owners at their discretion terminate or deny access to and use of the services to any individual or entity for any reason. Breach of any of the rules described in these terms or any specific agreement on and thorough our website will result in an immediate ban. 


SECTION 8 – INTELLECTUAL PROPERTY AND GRANT OF RIGHTS

All intellectual property rights related to the formation of the website such as the source code, logos, words, design, videos, samples, layout, graphics, photos, images, information, materials, documents (related to the website), data, databases, and all other information and intellectual property accessible on or through our website is the property of Shop AudioBooks and e-Audio Productions LLC and is protected by International intellectual property laws.

8.1. Limited License 

We grant you a non-transferable, non-exclusive and terminable right license to use our website. You agree that the title and ownership of the website and its services (apart from any of the author’s work) remain with us. You also agree not to copy (or allow a third party to copy), modify, create a derivative work, reverse engineer or reverse assemble, disassemble, or decompile the Shop AudioBooks’ website or any other action to allow its whole or partial re-use by the Seller or others. Please note that the title and ownership of data entered by the Seller remain with the original seller and copyright holder. Your license to our website may be suspended or terminated by us if you fail to comply with the necessary terms and conditions stated in this document. ts.

    

SECTION 9 – SECTION ENDORSEMENT DISCLAIMER 

Shop AudioBooks will have access to several different authors, writers, and sellers related to different fields of life. However, we do not endorse, recommend, approve or certify any information, advice, service, product, material, content or process,  presented or mentioned through our website none of the information from our website should be referenced in any way to imply any kind of approval or endorsement. We will not assume any liability for the accuracy or completeness of the information provided through our website’s content. 


SECTION 10 – COPYRIGHT NOTICES 

We will have other author’s work, material, and content through our website. It’s possible that we may not be able to check each and every work or material by an author for copyright infringement. If you have a reason to believe that your copyright work has been used in any of our services, in the website, or on or anywhere on our website that constitutes copyright infringement, please provide us information according to the method stated below. This procedure has been drafted in accordance with the Digital Millennium Copyright Act (“DMCA”). 

All infringement notifications must be submitted in writing to our website’s DMCA Agent at the email address listed below, and must include the following:

  1. Any kind of Identification of the infringed copyrighted work(s).

  2. Identification of the material or link allegedly hosting the infringing content.

  3. Details of the owners whose copyrighted work is being infringed. Details may include information such as mailing address, e-mail address, telephone number.

By using our services you agree that our website and company are not making any guarantees about the successful results of any gain and earnings of your income through our website. The information is being provided ‘as-is’ and you understand that any financial gain or loss resulting from the services of our website will be the result of users’ efforts, business, individual capacity, business experience, and level of desire. As a user, you hereby acknowledge that you will be responsible for your own success and you release our website from all financial liabilities.
